Property Selling Process in Bulgaria

It is not too complicated to sell your property in Sofia if the taxation, utilities and maintenance payments are up to date. Unfortunately, especially if you have been living overseas and depending on someone else, this is often not the case.

If you do not intend to be in Bulgaria for the signing of contracts or the notarization of the sale, then it is important to appoint a representative and provide them with a power of attorney. It is very important to appoint a reliable, honest representative for this process as there have been many cases of property owners losing their rights. Always use a courier such as FedEx or DHL to send documents back and forth to Bulgaria.

The first thing after agreeing a price for the property is to prepare a preliminary agreement with the buyer and collect the agreed deposit.  You must provide your representative with documents such as deeds, architectural plans, tax information and notary acts for them to create the agreement.

The first stage is for the representative to check if the property follows the legal and administrative regulations and to clear all outstanding liabilities related to the property.

The buyer may be taking out a loan on the property. The transaction cannot be completed until the bank provides evidence that the funds are in place.

To exchange the deeds the notary will require a tax estimation document which is issued by the local tax office and certificate of encumbrances which confirms that the property is clear of any mortgages or any other liabilities that could render the transfer invalid.

It is also important to consider how you want the funds from the sale transferred to your account in Bulgaria or overseas.
